Порядок поступления на военную службу по контракту
Гражданин, желающий поступить на военную службу, подает заявление в пункт отбора или военкомат. Это можно сделать по телефону, лично или через портал госуслуг. Заявление регистрируют и принимают к рассмотрению. После этого кандидат проходит мероприятия, на которых определяют его соответствие требованиям.
Что такое контрактная военная служба
Служба по контракту — это добровольная военная деятельность в Вооруженных силах России (ВС РФ) на особых условиях: наличие зарплаты, соцпакета, ряда льгот, денежных компенсаций и поощрений. К кандидатам в контрактники есть ряд требований, закрепленных в законодательстве, а соответствующий условиям гражданин может подписать контракт с Министерством обороны.
Несмотря на то что договор заключается на определенный срок, уволиться из Вооруженных сил по его окончании не получится: пока в России действует период частичной мобилизации контракты с военнослужащими автоматически продлеваются. Это значит, что покинуть ряды армии можно только по состоянию здоровья (с категорией «Д»), достижению пенсионного возраста или приговору суда.
Какие требования предъявляют к контрактникам
В первую очередь, возраст — на контрактную военную службу берут мужчин и женщин от 18 лет. Одну из ключевых ролей играет годность по здоровью — по результатам военно-врачебной комиссии кандидат должен попасть в одну из групп: «А» (годен к военной службе) или «Б» (годен к военной службе с незначительными ограничениями).
Кроме того, согласно приказу министра обороны России, подписать контракт в условиях мобилизации и военного положения могут и некоторые ограниченно годные по здоровью россияне — то есть те, у кого в военном билете стоит категория «В». Однако и здесь есть ограничения: ведомство перечислило 26 пунктов с заболеваниями, препятствующими зачислению на контракт в период мобилизации. Среди них сахарный диабет I типа, эпилепсия, пережитые инсульты, злокачественные опухоли, бронхиальная астма средней степени тяжести и другие болезни и состояния здоровья. Подходит ли кандидат, определят после медосмотра, который проведут в военном комиссариате.
Поступить на военную службу по контракту могут и иностранцы, которые законно проживают в России.
Когда могут отказать в приеме на службу по контракту
Гражданину могут и отказать в приеме на службу в соответствии с пунктом 5 статьи 34 Федерального закона от 28 марта 1998 г. № 53-ФЗ «О воинской обязанности и военной службе». Основанием могут быть:
- отсутствие в ВС РФ и других воинских формированиях вакантных мест, соответствующих профилю подготовки и военно-учетной специальности кандидата;
- решение аттестационной комиссии, утвержденное командиром воинской части о заключении контракта с другим кандидатом по итогам конкурса;
- решение военного комиссариата, совместной комиссии пункта отбора и других ведомств о несоответствии кандидата по требованиям, указанным в Федеральном законе.
Контракт не может быть заключен с гражданами, в отношении которых вынесен обвинительный приговор или ведется дознание, следствие, уголовное дело. В контракте отказывают людям с непогашенной судимостью, отбывающим наказание в виде лишения свободы, подвергнутым административному наказанию за употребление наркотиков и психотропных веществ.
Что касается многодетных отцов, то на сегодняшний день призыву на срочную службу они не подлежат. Но оснований, чтобы не заключать с ними военный контракт, нет. При этом, российское правительство поддержало законопроект, который предлагает предоставить отцам трех и более детей возможность поступить в мобилизационный резерв.
Заключив контракт с Минобороны, такие граждане лишатся права на освобождение от мобилизации, введенную для многодетных.
На каких условиях можно уволиться с контрактной военной службы
Согласно законодательству, уволиться со службы можно по окончании срока контракта или по состоянию здоровья, если человек получил травму и больше не может выполнять свои обязанности.
Основания для досрочного увольнения с контрактной службы:
- в связи с существенным и систематическим нарушением условий контракта в отношении военнослужащего;
- по семейным обстоятельствам, если член семьи военнослужащего не может проживать в регионе прохождения службы по медицинским показаниям, а возможности перевестись в другое место нет;
- если военнослужащему нужно постоянно ухаживать за нуждающимися в помощи членами семьи — отцом, матерью, женой, мужем, родным братом, родной сестрой, дедушкой, бабушкой, усыновителем или ребенком до 18 лет;
- в связи с наделением военнослужащего полномочиями высшего должностного лица субъекта Российской Федерации или избранием в Совет Федерации, Госдуму и так далее.
При этом досрочно разорвать договор с Минобороны или уволиться по его истечении сейчас нельзя. Согласно указу президента «Об объявлении частичной мобилизации в Российской Федерации», у контрактников есть только три причины для увольнения: достижение предельного возраста, негодность по здоровью — то есть получение категории «Д», приговор суда о лишении свободы.
